Did you know that there’s a difference between the DREAM Act and DACA? The DREAM Act consists of a series of proposed laws that could provide a pathway to citizenship for undocumented youths who immigrated to the United States as children. Since these undocumented youths are considered illegal immigrants, the proposed DREAM Act is considered a reformation of immigration laws that would enable undocumented youths to be protected against deportation. Currently, DACA is the only pathway undocumented immigrants have to obtain an education within the United States and protection from deportation as long as they abide by immigration laws. Additionally, the DREAM Act could help undocumented immigrants obtain a green card and lawful permanent residency within the states. That’s why they call them “dreamers.”
The DREAM Act is Not a Law
The DREAM Act has been proposed to Congress for over 20 years. The DREAM Act was first introduced to Congress by Sen. Dick Durbin and Sen. Orrin Hatch, Democratic Senators, in 2001. The DREAM Act stands for the development, relief, and education for alien minors, also referred to as “dreamers.” Under the DREAM Act, only certain minors would be eligible to apply – illegal aliens who entered the country under the age of 16 who have lived within the U.S. for at least 5 years. Since 2001, the DREAM Act has failed to pass and become law, despite recently being voted on in 2021.
There’s a New Bill for the DREAM Act
As of March 2021, the most recent DREAM Act presented to Congress now has the name “American Dream and Promise Act 2021.” This particular bill has similar qualities to the original DREAM Act and intends to provide a pathway to citizenship for undocumented illegal youth so long as they meet certain eligibility criteria. This latest bill proposes a three step pathway to citizenship and passed within the House of Representatives, but has yet to be voted on by the Senate.
Illegal Immigrants Can Still Find Relief
Even though the DREAM Act hasn’t become a reality, illegal immigrants can still find relief through DACA. DACA applicants can use DACA as a form of temporary protection to obtain a two year work permit that enables them to stay within the United States. Additionally, DACA is renewable, meaning that you can renew it upon expiration so long as you abide by immigration laws and do not commit any crimes.
