What Maryland Law Actually Says About Fathers’ Custody Rights

One of the most persistent misconceptions in family law is that Maryland courts automatically favor mothers in custody disputes. That hasn’t been the legal standard for decades, and the law now makes it explicit. Maryland courts decide custody based on the best interests of the child standard, which focuses on the child’s needs rather than a parent’s gender.

House Bill 1191, effective October 1, 2025, strengthened this framework by codifying a statutory list of custody factors under Family Law Section 9-201 for the first time. Previously, judges drew on Maryland case law to guide best-interests determinations. Now those considerations are written directly into statute. The codified factors include:

  • Physical and emotional safety: The court must weigh each parent’s ability to protect the child from harm
  • Frequent and continuing contact: Courts consider contact with parents who act in the child’s best interest
  • Parental responsibility-sharing: How parents divide day-to-day and long-term responsibilities
  • Relationships with parents and siblings: The child’s bond with each parent and any siblings in the household
  • Home location and military deployment: Geographic distance and any active-duty military status affecting parenting time

HB 1191 also requires judges to explain their custody reasoning on the record, which gives fathers a clearer basis for understanding and, where appropriate, challenging a court’s decision. Establishing Paternity in Maryland

For unmarried fathers, establishing paternity is often the starting point for pursuing custody or visitation, though it doesn’t always have to happen before a custody case begins. Maryland law provides two paths to legal paternity.

Affidavit of Parentage

Both parents can sign this document at the hospital after birth. Once executed, it functions as a legal finding of paternity and can generally only be rescinded within 60 days, absent fraud, duress, or a material mistake of fact.

Court Proceeding

If paternity is uncertain, either parent can request genetic testing through the Child Support Administration. A father can also file a complaint for custody or visitation and have paternity determined within that same action, so there’s no need to resolve paternity in a separate case before pursuing custody rights.
