Vehicular Homicide While Impaired by Alcohol, Drugs, or a Controlled Substance

  • A felony offense that is punishable by up to 3 years of imprisonment and a fine of up to $5,000

According to Maryland Transporation Code § 21-901.1., reckless driving is defined as driving “in wanton or willful disregard for the safety of persons or property.” This law also includes negligent driving, which is a lesser offense defined as driving “in a careless or imprudent manner that endangers any property or the life or person of any individual.” 

The penalties for these offenses are as follows:

Reckless Driving

  •  A misdemeanor offense punishable by a fine up to $1,000 (although it starts at $510 and can be reduced or increased)
  • 6 points added to your driving record

Negligent Driving

  • A misdemeanor offense punishable by a maximum fine of $500 (although the scheduled fine is only $140 and a judge can decide to increase or reduce the fine)
  • 3 points added to your driving record 

The Maryland Point System

The Maryland point system is straightforward. The following point totals, acquired over the course of 2 years, can lead to several warnings and penalties, including:

  • 3-4 points: A warning letter
  • 5-7 points: Enrollment in a Driver Improvement Program
  • 8-11 points: Suspended license
  • 12+ points: Revoked license
