Maryland DUI Charges Dismissed After Suppression Hearing

Albers & Associates got their client’s Maryland DUI charges dismissed.  My client’s Maryland DUI charges were dropped by the State’s Attorney’s Office after the Court granted my motion to suppress the police stop.

My client was charged with drinking and driving after a police officer watched him parallel park and strike the car behind him. My client failed the field sobriety tests and refused the breathalyzer.

Maryland DUI Charges Dismissed because Police Stop Suppressed

The prosecutor offered my client a plea to the DUI and jail.

I advised that I thought the police stop was bad and wanted a motion to suppress hearing. Police officers can stop people if they have a reasonable articulable suspicion that criminal activity has occurred, is occurring, or is about to occur.

In this case, my client was stopped for a bad parallel parking job.

The State called its first witness: the police officer who wrote the report, but did not observe the alleged accident or conduct the initial stop of my client.

This officer testified that he responded to a call for a vehicle crash. Upon arrival, the observing officer was already there with my client.

Essentially, the reporting officer had no personal knowledge regarding the stop.

My argument was simple: the State could not prove the stop was reasonable because the observing officer had never testified.

The judge agreed with my argument and ruled that the State could not prove that the observing officer had probable cause to stop my client, since this officer never testified.

The State then drop all charges against my client.
