Arrested for Maryland DUI? CDL driver? Your 45 day temporary license is valid.

A 45 day temporary CDL license is a possibility after a Maryland DUI arrest.

I was contacted by a Maryland DUI offender for a free home consultation.  I immediately scheduled a consultation for the same day and met with the defendant and his family at their home.

After, my free consultation Albers & Associates were retained by the client for a DUI that he received in Maryland over the weekend.

The client was concerned about whether or not he could still operate a commercial vehicle while holding a temporary 45 day license.  The client’s CDL was confiscated by the police after his arrest and he was issued a temporary 45 day license.

I immediately placed a call to my MVA insider and investigated the matter for my client.

CDLs are treated differently by the MVA than regular Class C licenses in driving under the influence cases.  In a typical first time DUI offender situation, the client’s Class C license is confiscated and they are issued a temporary 45 day license.  If they do nothing, then their license will be suspended on the 46th day after their arrest.  If they request an MVA hearing within 10 days at the Office of Administrative Hearings, then they will be issued an extension letter extending their privilege to drive until their MVA hearing.

However, for individuals like my client that rely on their CDL to make a living, it’s a serious issue if they cannot operate a commercial vehicle.

I explained the situation to my contact at the MVA and was advised that the client’s 45 day temporary CDL license is valid both as a regular Class C and CDL.  Additionally, if the client requests a MVA hearing within 10 days, then the extension letter will extend my client’s driving privileges as to their Class C and CDL until their MVA hearing.

A conveyed this information to my client immediately and he was very happy with the answer and my quick response.  Providing information quickly to clients is imperative when it comes to their driving privileges.  Misinformed clients can easily get in more trouble by driving on what they thought was a valid license, but is actually a suspended privilege.

Maryland commercial driver’s licenses are treated much differently by the MVA.  It’s important to have an DUI attorney that understands and has access to information when dealing with potential MVA consequences.
