Driving under the influence carries serious MVA DUI Consequences

MVA DUI consequences may still exist even if you are found not guilty at trial in the district court or circuit court for driving under the influence.  It’s a common misconception among potential Maryland DUI clients that if they are found not guilty at trial or have their case dismissed by the State, then their MVA license suspension or restriction will end, too.

That is not the case.  In fact, the MVA and courts are very different entities that may have an effect on your driver’s license and freedom.

If you are charged with a first offense DUI in Maryland, then you are facing serious MVA DUI consequences such as a suspension of your driving privilege or admission into the MVA’s interlock program for one year.  Typically, a suspension or the interlock is imposed on your driver’s license before your trial date in the district court.

At trial, if you are found not guilty by a judge or jury, then you will face no punishment by court.  However, your MVA suspension or restriction will stay in place.

The same is true if you request an MVA hearing and win your case at the Office of Administrative Hearings.  You can still be found guilty at trial in court and go to jail or be placed on supervised or unsupervised probation.
