Should I report my DUI arrest to my employer?

Our office starts your free Carroll County or Howard County DUI consultation with a simple question: What are your biggest fears?  Many times, our clients say, “Should I report my DUI arrest to my employer?”

It’s a simple question, that could significantly affect your job and family’s well-being.  Unfortunately, the answer is often, “It depends.”

Consult your company’s employee manual or HR department

When clients ask us whether they should report their DUI arrest to their employer, we direct them to their company’s employee manual.  Sometimes, a company’s employee manual will explain in detail a employee’s duty to report any arrests.  If it doesn’t, then sometimes a company’s human resources department may have a way to anonymously asks questions.

Usually, the anticipation of your reporting your DUI arrest is worse than your company’s reaction.  For example, our office represented a client worried about reporting their DUI arrest to their new employer.  The anticipation of reporting their DUI arrest consumed our client with anxiety.  We advised our client to set up a meeting and tell their employer as soon as possible.  After the meeting, our client reported that their employer took the news well, and actually, was very supportive.

In our opinion, it’s always best to come clean about your DUI arrest with your employer.  Hiding it may actually result in worse consequences, especially if you have a duty to report any arrests and don’t.

A Maryland DUI arrest can be embarrassing, and not someone you may want to share with your family, friends and co-workers.  Ultimately, the decision is up to you.  Our office routinely helps clients answer any questions their employers might have about their Carroll County or Howard County DUI arrest.
