MVA Point System

The MVA has created a point system wherein each moving violation carries a certain number of points.

For example, a speeding ticket 1-9 miles over the speed limit will result in 1 point, 10-29 miles over the limit is 2 points (except 20 or more over a 65 m.p.h. limit is 5 points), and 30 miles or more over the limit is 5 points.

Points only apply to moving violations. They do not apply to parking tickets, violations that are not considered to be moving violations, or camera tickets.

Points stay on your record for two years from the date of the offense for MVA purposes. If you accumulate 5 points or more, the MVA will send you a letter ordering you to do a Driver Improvement Program or your license will be suspended. If you reach 8 points, the MVA will send you a notice that your license will be suspended. If you reach 12 points, the MVA will send you a notice that your license will be revoked.

If you receive a probation before judgment (PBJ), then no points will be added to your driving record because a PBJ is not a conviction.

If convicted in Maryland, a DWI carries 8 points and a DUI carries 12 points.  You can see how quickly points can be accumulated and the importance of retaining an attorney to make sure your case is dismissed or granted a PBJ.
