Underinsured Motorist (UIM) coverage protects you against drivers that carry minimal insurance coverage.
Recently, we settled a UIM car accident case for $85,000. The at-fault driver, in Delaware, carried the minimum policy of $15,000/$30,000. Meaning, the person who caused the accident only had $15,000 to pay for our client’s medical bills and injuries. Our client’s medical bills and lost wages were approximately $50,000.
As of July 1, 2018, Maryland law requires that insurance companies offer an Enhanced UIM policy to drivers. You should contact your insurance agent and ask for an Enhanced UIM policy.
New Maryland UIM Law
Enhanced UIM allows you to stack your policy on top of the at-fault party’s policy. So, if the at-fault party has $30,000 and you have $100,000, you now have $130,000 of insurance available to cover your harms and losses. Under the old law, you would only have $100,000 available to you because the insurance policies did not stack on top of each other. This was really unfair to victims of car accidents and other personal injury claims.
