Worried about losing your job after a DWI arrest?

As with most legal advice, the answer is: “It depends.”

It depends on your job.  In our experience, most clients do not lose their job.  We advise clients to report their DUI arrest, if they have a duty to report or feel it is better to come clean with their employer.  Some clients report their arrests, others do not.  If you aren’t required to report it, then it’s a personal decision.

We find that many employers are supportive after a DUI arrest and will often be willing to write a character letter to the court.  In fact, some employers will even come to court to speak on behalf of their employees.

We ease our client’s anxiety about losing their job after a DUI arrest by asking them several questions:

  1. Are you a good employee?
  2. Do your supervisors and co-workers like you?
  3. Do you make the company money?
  4. Would it be harder to fire and replace you, than to retain you as an employee?

If the answer to these questions are “yes,” then you probably won’t lose your job.  However, if your employer is looking for a reason to fire you, then a driving under the influence arrest may be the last straw.

While it is unlikely that you will lose your job, it is a possibility and one you should take very seriously and that we can address at your free consultation.
