You Will Be Required to Go to Court

Most first-time Maryland DUI offenders are charged with driving under the influence, driving under the influence per se and driving while impaired.  Additionally, you may be charged with the underlying traffic citations, like speeding or unsafe lane change.

Criminal penalties for a Maryland DUI include jail and a fine.

Five days after your arrest, you may have an arraignment hearing in front of a district court commissioner. At this hearing, you will be advised of the charges against you, select a trial date, and told to obtain the services of a private DUI attorney or public defender.

At your trial date, you and your DUI attorney will appear in the district court.  On this day, you can plead guilty, have a bench trial, or request a jury trial.  Additionally, your case could be postponed or dismissed by the State’s Attorney’s Office.

If you request a jury trial, then your case will be transferred to the circuit court.

You May Lose Your Driver’s License

Depending on the nature of your DUI, your license may be suspended, or restricted.

You can request a MVA hearing within 10 days of your arrest.  At the hearing, you can challenge the suspension of your driver’s license or ask for a modification.

You have the right to be represented by an attorney during your MVA hearing.

If you are convicted of driving under the influence or driving while impaired, then the MVA will assess points against your driver’s license.  Depending on the number of points, your license could be affected.

Be Prepared to Have an Alcohol and Substance Abuse Assessment

Many people make the mistake of drinking and driving.  Sometimes it results from substance abuse.  Other times it was just bad decision.

Anyone arrested for DUI must complete an alcohol assessment and education program.  The circumstances of your DUI and assessment will determine the level of treatment.
