New DUI MVA Penalties

Effective October 1, 2016, there will be new DUI MVA penalties regarding the breathalyzer test.  Bottom line: the interlock is going to become the norm in most DUI cases.

New DUI MVA Penalties: 0.08-0.14

Beginning October, the MVA penalties for a first offense BAC 0.08-0.14 will increase from a 45 day suspension/modification to 180 day suspension/modification/interlock.

For a second offense BAC 0.08-0.14, the MVA penalties will increase from a 90 day suspension/modification to 180 day suspension/modification/interlock.

New DUI MVA Penalties: 0.15 or more

Beginning October, the MVA penalties for a first offense BAC 0.15 or greater will increase from a 90 day suspension, or one year interlock to 180 day suspension, or one year interlock.

For a second offense BAC 0.15 or greater, the MVA penalties will increase from a 180 day suspension, or one year interlock to 270 day suspension, or one year interlock.

New DUI MVA Penalties: Refusal

Beginning October, the MVA penalties for a refusal will increase from a 120 day suspension, or one year interlock to 270 day suspension, or one year interlock.

For a second offense refusal, the MVA penalties will increase from a 1 year suspension, or one year interlock to 2 year, or one year interlock.
