Enrolling in the DUI Ignition Interlock program

For many clients charged with a DUI in Maryland, our office recommends that they install the ignition interlock in their car in order to keep driving after a drunk driving arrest.  Remember, the MVA suspends your driver’s license after a DWI arrest depending on the results of the breathalyzer test.

While many of our clients install the interlock, they forget to take the next step which is to go to the MVA and enroll in the interlock program.  Installing the interlock does not make you part of the program, you have to officially enroll at the MVA.  Once you do that, you will be issued a new driver’s license and your one year of interlock begins.

What are the suspension periods after a DUI arrest in Maryland?

The suspension periods are as follows after drunk driving arrest in Maryland:

Blood Alcohol Content 0.08 through 0.14

For a first time DUI arrest the license suspension period is a 180-day suspension, or you can request a modification of the suspension to allow you to drive for employment purposes.

Blood Alcohol Content 0.15 or more

For a first time DUI arrest the license suspension period is a 180-day suspension, or you can install the interlock on your car for one year.

Refused to submit to the test

For a first time DUI arrest the license suspension period is a 270-day suspension, or you can install the interlock on your car for one year.

When to install the interlock after a DUI arrest?

Typically, we recommend that clients install and enroll in the interlock program if their BAC was 0.15 or more, or they refused the breathalyzer test.  As you can see from above, your two options are taking the suspension or install the interlock for one year.  Most clients can’t have their license suspended, so they opt for the interlock.

However, despite our instructions, many clients fail to take their interlock installation paperwork to the MVA after installing the interlock.  They believe they are enrolled in the program because they installed the interlock.

Remember, you must go to the MVA after your install the interlock to officially enroll in the program.
