DUI Temporary License Expires after 45 Days

After your DWI arrest, your driver’s license will be confiscated and you will be issued a temporary driver’s license.

The temporary license is valid for 45 days.  If you do nothing, then on the 46th day after your address, your temporary license will expire and your privilege to drive in Maryland will be suspended.

The results of your breathalyzer test determine the type of suspension your face from the MVA.

Recently, we were retained by a client that was arrested for a DUI in Carroll County.  This person’s breathazlyer results were a 0.10.

Based on that result, this client was eligible to have their suspension modified so that they could drive for employment purposes.

Here, the client had 30 days from the date of their arrest to request a MVA hearing to ask for the modification.

Problem is, this client didn’t speak to a DUI attorney until almost 45 days after their arrest.  Their license was almost expired.

The client tried to request a MVA hearing, but that request was denied for not complying with the timing requirements.

Unfortunately, instead of having a modified suspension and being able to drive, this client now has to have the interlock installed in their car in order to drive.
