Common Terms

BAC – This is your “blood alcohol concentration.” It can be measured by taking samples of your blood, urine, or breath. BAC is measured as a percentage.

The Legal Limit – The legal limit for BAC is .08% in all 50 states. If you get behind the wheel of a car with a BAC of .08% or higher and are pulled over, you will be charged with a DUI.

Implied Consent – When you apply for a driver’s license, you are agreeing to be tested for intoxication if you are suspected of driving while under the influence.

OUI/OWI – These can be used interchangeably with “DUI/DWI.” Rather than driving under the influence, you are “operating” under the influence.

Breathalyzer – A device that law enforcement officers can use to determine your BAC.

Noah’s Law – This law, also known as the Drunk Driving Reduction Act of 2015, was design to expand the use of the ignition interlock program in the state of Maryland and to create harsher penalties for DUI convictions. It was named after a police officer who was struck and killed by a drunk driver during a DUI arrest.
