DUI Probation Special Conditions

When you are placed on probation after a DUI arrest there are two types of conditions: standard conditions and special conditions.

Standard conditions are the universal conditions that apply to all probations.  Special conditions are the unique conditions imposed by your judge.

So what are some types of special conditions that a judge can impose as part of your probation?

Judge imposed special conditions

Typically, the first special condition imposed by a judge is that you pay all fines, costs, restitution, and fees imposed by the judge.

Then, a judge may order that you refrain from driving or attempting to drive after consuming alcohol.  Remember, it’s not illegal to drink it drive, it illegal to be under the influence.  However, with this special condition, you are not permitted to drive after consuming any alcohol.

If you haven’t done so already, the court will also make it a special condition that you enroll in and successfully complete an alcohol treatment program.  We advise clients to complete this prior to appearing in court.

Additionally, the court will likely order you to attend a victim impact panel meeting.  This is program usually put on by Mothers Against Drunk Driving or another organization.

Another special condition that could be imposed is to attend self-help group meetings.  These are typically AA meetings.

Finally, the court could impose a few hours of community service.

Some special conditions are more common than others.  For example, paying fines and attending a victim impact panel.  Others, like community service, are less common in a DUI case.

Ultimately, it depends on the judge.
