Car totaled by insurance after car accident

For some of our clients injured in automobile accidents, the worst part is having their car declared a total loss by the insurance company because they are left without a vehicle.

Here’s how it works.  The at-fault driver damages your car beyond repair, or the cost of repair is deemed more than the fair market value of your car.  So, the insurance company totals your vehicle and sends you a check for the fair market value.  If your car is old and has a lot of miles on it, then it probably isn’t worth much, maybe a couple thousand dollars or less.

While your car is being totaled, the insurance company provides you with a rental car.  However, once they pay the property damage claim, the insurance company stops paying for the rental car and you must either return it or pay for it yourself.

Now, you’re left without a car but have a check for the fair market value of your vehicle.  It may or may not be enough to buy another car.

Even if you buy a new car, now you have a car payment that you didn’t have before the accident.  Or, if you owed more on the totaled car than it was worth, then you’re paying for a vehicle you don’t have anymore.

Often times the most inconvenient part of being in a car accident aren’t your injuries, but the loss of your vehicle.

So, what can you do?  If you’re injured and treat for your injuries, then you can make up for the loss of your vehicle by negotiating a higher settlement.  Additionally, if you file a lawsuit and go to court, then you can argue that the loss of your vehicle was an inconvenience.
